HOORAND / LEGAL
General Terms & Conditions
Updated: 2026-11-03
1. Provider and scope
These conditions apply to transport, forwarding, warehousing, documentation and related logistics services accepted by Hoorand Co. International Transport, Tehran, Iran (Hoorand). Contact: Djawaheri Building, Berlin Street, Ferdowsi Avenue, Tehran, Iran; +98 21 3391 6787–9; hit@hoorand.com. They form part of a booking when supplied or referred to and accepted by the customer. Browsing this website or sending an enquiry does not itself place an order.
2. Contract and priority
A shipment is accepted when Hoorand confirms the booking in writing, including by email. Mandatory law and applicable international conventions take priority, followed by the individually agreed booking and these conditions. Hoorand’s role as forwarder, agent, contractual carrier or service provider is determined by the agreed service and the documents issued. German ADSp conditions are not incorporated by this website.
3. Quotations and shipment information
An offer applies to the cargo, route, service, currency and validity stated in it and remains subject to final written confirmation of capacity and feasibility. Customers must give accurate descriptions, package counts, dimensions, gross weight, value where relevant, addresses, dates, Incoterms, customs information and special requirements. Changes may require a revised quotation. No price or delivery guarantee arises from general website descriptions.
4. Road, air, sea and multimodal services
Road services may include full loads, part loads and consolidation. Air services are subject to carrier acceptance, security screening, chargeable weight and document requirements. Sea services may include full or part containers, with equipment, verified gross mass, cut-offs, free time and release conditions specified in the booking. Multimodal services combine agreed transport stages and handover points. Weekly departures are available only on confirmed routes and dates. Delivery estimates are not guaranteed deadlines unless expressly accepted as such, subject always to mandatory liability rules.
5. Packaging, loading and special cargo
The customer must arrange packaging, markings, securing and documents suitable for the agreed journey unless Hoorand expressly accepts that work. Loading, securing, unloading and equipment responsibilities must be agreed before dispatch. Dangerous, temperature-sensitive, perishable, oversized, high-value or restricted goods require advance disclosure and written acceptance. Relevant safety data, handling instructions, declarations and permits must be supplied in time. Hoorand may refuse unsafe or incorrectly declared goods and will seek lawful instructions where practicable.
6. Customs, permits and lawful trade
The customer supplies complete and accurate commercial, customs and licensing documents and identifies the parties and intended use where required. Representation before authorities requires the necessary authority and acceptance by Hoorand. Import, export and transit remain subject to applicable laws, permits, trade restrictions and carrier requirements. Hoorand may suspend or refuse a prohibited operation, promptly inform the customer where lawful and consider a lawful alternative. Customs clearance and official inspection outcomes cannot be guaranteed. Each party remains responsible for its own legally attributable acts or omissions.
7. Charges and payment
The written quotation or booking states the freight, included services, currency, payment deadline and any agreed conversion method. Taxes, duties, terminal charges, examinations, waiting, storage, demurrage, detention, re-delivery, special equipment, bank charges and other third-party costs are included only when expressly stated. Additional charges must have a contractual or legal basis and be explained, with supporting information where applicable. Material cost or route changes are communicated for agreement where practicable. Cancellation charges reflect agreed terms and reasonable, demonstrable commitments already incurred. Statutory payment defences and mandatory rights remain unaffected. Cargo or documents may be retained only where a valid legal or contractual right permits it; this clause creates no unrestricted right to hold unrelated cargo.
8. Routing, storage and non-collection
Hoorand may use suitable carriers and logistics partners to perform the agreed service. Material changes to route, transshipment or delivery arrangements will be communicated where practicable. Storage conditions and free periods apply only as agreed or required by law. If goods are refused or not collected, Hoorand will seek instructions and take reasonable protective steps. Necessary additional handling, storage, return or disposal requires a lawful basis; costs are allocated under the contract and applicable law. Goods are not deemed abandoned merely because an invoice is disputed.
9. Liability and cargo insurance
Liability depends on Hoorand’s agreed role, the service and the law governing the relevant transport stage. The CMR Convention applies to road carriage within its scope; air carriage is governed by the applicable mandatory air-carriage regime, and sea, rail and multimodal movements by the applicable mandatory rules and transport documents. There is no single liability limit covering every service. Mandatory liability, including rules on loss, damage, delay and conduct that removes a limitation, is not excluded. Cargo insurance is separate from carrier or forwarder liability. It is arranged only after a written request and confirmation of the cover, value, conditions and premium; requesting a quotation does not create insurance.
10. Delivery, damage and claims
Check goods and packaging on delivery and record apparent loss or damage on the delivery document. Notify Hoorand promptly in writing, with the transport reference, photographs and supporting documents, and preserve relevant evidence. The notice periods, limitation periods and competent courts of the applicable mandatory regime remain controlling; this website does not shorten them. Commercial discussions do not automatically suspend a legal time limit.
11. Disruption and force majeure
A party affected by an event beyond its reasonable control must give timely notice where practicable, take reasonable steps to reduce its effects and cooperate on alternatives. Border closures, conflict, official measures, strikes, severe weather and carrier disruption are assessed against the contract and applicable law. Revised routing, costs, storage or termination require the appropriate contractual or legal basis. This provision does not excuse a party’s own fault or create an automatic entitlement to payment for unperformed services.
12. Data, governing law and disputes
Information is used as described in Hoorand’s Privacy & Cookies notice. Iranian law governs to the extent permitted by applicable conflict-of-law rules and mandatory international conventions. The parties should first seek an operational resolution through hit@hoorand.com. Unresolved disputes go to the courts competent under the applicable law or convention; a separate valid written dispute-resolution agreement may apply. No exclusive foreign court or arbitration is imposed by browsing this site. The Persian text is the reference version for interpretation where legally permitted, without overriding a mandatory rule or an individually agreed contract language. If a provision is ineffective, the remaining provisions continue to the extent permitted by law. Updates do not retrospectively change an already accepted booking.
